We value your privacy and are committed to protecting your personal data. This privacy policy explains how we collect, use, and protect your information when you visit our platform, register for an account, interact with our services, or provide feedback.

2. Data Collection and Processing

a) Visiting the Platform

When you visit our platform, the following data may be collected automatically by our servers:

• IP address
• Browser type and version
• Device type and operating system
• Referrer URL (the previously visited page)

This information is necessary for the proper functioning of the platform and is processed based on our legitimate interest (Art. 6(1)(f) GDPR).

b) Registration and Login

To use certain features (e.g., writing reviews), you need to register or log in. TerraMigos allows you to log in using:

• Google
• LinkedIn
• Microsoft
• Facebook
• TerraMigos user account with email address and password (must be registered once)

When logging in via these services, we only collect your email address.

In order to provide content to the platform, you have to create a user profile collecting the following data:

• Your name or nickname (mandatory)
• Optional profile details (country, description, profile picture)

We process this data to manage your account and enable platform functionality (Art. 6(1)(b) GDPR).

c) Place Reviews and Likes

When submitting reviews, we collect:

• Title, rating and information whether you have visited the place (mandatory)
• Date when the review was last updated (mandatory)
• Month of visit, detailed review text, and photos (optional)

Your reviews and author user profile will be publicly visible to all visitors. The processing of this data is based on your consent (Art. 6(1)(a) GDPR).

When you like a place review, we store:

• Your user profile ID
• The review ID you liked
• The date and time of the like

Other users will only see the total number of likes a review has received, but not who liked it. This data is processed based on our legitimate interest in enabling user engagement (Art. 6(1)(f) GDPR).

d) User Profile Follows

When you follow another user profile, we store:

• Your user profile ID
• The profile ID you follow
• The date and time of the follow

Other users will only see the total number of followers a profile has, but not individual followers. As part of this feature, we send email notifications to followers when the profile they follow publishes a new review. The processing of this data, including sending notifications, is based on your consent when using the follow feature (Art. 6(1)(a) GDPR).

e) Newsletter Subscription

You can subscribe to our newsletter via the Brevo service (formerly Sendinblue). We use a double opt-in process to confirm your subscription. For this, we collect:

• Your email address
• Confirmation timestamps

The processing of your data for the newsletter is based on your consent (Art. 6(1)(a) GDPR).

f) Turnstile Anti-Bot Protection

To prevent spam and unauthorized signups, we use Turnstile, a CAPTCHA alternative provided by Cloudflare, e.g. as part of the newsletter subscription process.

As part of the check, Turnstile may process the following data:

• IP address
• Browser and operating system information
• Interaction data (e.g., mouse movements, clicks)

This data is processed solely to verify that the interaction is performed by a human and not an automated bot. The use of Turnstile is based on our legitimate interest in protecting the security and integrity of our services (Art. 6(1)(f) GDPR).

g) Support Chat

We use Tawk.to to provide live chat support. When interacting with the chat, your messages and related metadata are stored to respond to your inquiries.

h) Analytics and Tracking

We use Google Analytics to track visitor interactions and improve our platform. This involves cookies that may collect:

• Pages visited
• Time spent on the site
• User behavior patterns

This data is processed based on your consent (Art. 6(1)(a) GDPR).

i) Ads and Affiliate Links

We display ads and affiliate links from various travel related providers like Expedia, GetYourGuide, Hotellook, Trip.com, TravelUp, BikesBooking, AutoEurope and EconomyBookings.

These services may use cookies to display relevant advertisements and track affiliate commissions. Processing is based on your consent (Art. 6(1)(a) GDPR).

j) Maps

We use Maptiler for displaying maps. When using map features, data such as your IP address and interaction with the map may be collected based on your consent to tracking cookies.

k) Bucket List, Visited Places, and Travel Statistics

When you use features such as the personal bucket list or mark places as visited, we store information about:

• Places you have added to your bucket list
• Places you have marked as visited through reviews
• Aggregated statistics about visited places

Bucket list information is visible only to you. Aggregated visit statistics and visited indicators may be visible on your public user profile and on place pages.

This data is processed to provide personalized features and to display your travel activity on the platform. The processing is based on the performance of a contract (Art. 6(1)(b) GDPR).

l) Trip Planning and Itinerary Management

When you use the trip planning features of TerraMigos, we process additional data you provide to create, manage, and refine your travel plans. This may include:

• Trip details such as destinations, travel dates, duration, and preferences
• Itinerary elements including stays, activities, transport segments, notes, and expected costs
• Booking-related information entered by you (e.g., accommodation or transport references)

This data is processed solely to provide the trip planning functionality and to allow you to view, edit, and manage your trips.

The processing is based on the performance of a contract (Art. 6(1)(b) GDPR), as these features are part of the services you request when using the platform.

m) AI-Based Trip Planning and Content Generation

TerraMigos uses AI-based services to support features such as itinerary draft generation and itinerary refinement. For this purpose, selected user-provided content (e.g., trip parameters, itinerary elements, and planning preferences) may be transmitted to external AI service providers for processing.

AI-based processing may also be used to generate or enrich general, non-personal place-related information (e.g., travel hints, climate summaries, or country information) based on publicly available sources and user-provided content.

The AI processing is performed exclusively to generate suggestions and planning assistance requested by you. AI-generated content is not stored by the AI provider beyond the processing required to return the result.

The use of AI-based services is based on the performance of a contract (Art. 6(1)(b) GDPR) and our legitimate interest in providing an efficient and innovative planning experience (Art. 6(1)(f) GDPR).

n) AI Usage Logging and Credit Management

To manage usage limits, ensure system security, and prevent abuse, we store technical usage data related to AI-based features. This may include:

• The type of AI operation performed
• The number of credits consumed
• Timestamps of the operation

This data is not used for profiling and is processed solely for operational, security, and accounting purposes.

The processing is based on our legitimate interest in ensuring fair use and reliable operation of AI-based features (Art. 6(1)(f) GDPR).

3. Cookie Policy

We use cookies and similar technologies to enhance your experience on our platform. Cookies are small files stored on your device that help us:

1. Essential Cookies: Ensure the platform functions correctly.
2. Analytics Cookies: Track site usage to improve performance (e.g., Google Analytics).
3. Advertising and Affiliate Cookies: Track affiliate interactions through partner programs.

You can manage your cookie preferences through the consent banner displayed on your first visit or later through the "Legal" - "Cookie Consent" footer menu, or adjust settings in your browser. Your cookie consent data is stored for a maximum of 1 year in the browser local storage.

4. Third-Party Services

We use third-party services to provide certain features and functionality. Your data may be shared with:

• Google (Google Analytics and authentication)
• Maptiler (maps)
• Brevo (newsletter management)
• Cloudflare (Turnstile anti-bot protection)

• AI service providers (e.g., OpenAI) for AI-assisted trip planning
• Affiliate Partners (GetYourGuide, Hotellook, Trip.com, TravelUp, BikesBooking, AutoEurope, EconomyBookings)

These services comply with GDPR, and data processing agreements are in place.

We retain your data only for as long as necessary to provide our services or comply with legal obligations. You can request deletion of your data at any time by contacting us at privacy@terramigos.org.

Under GDPR, you have the right to:

• Restrict data processing

• Request data portability
• Withdraw consent
• Lodge a complaint with a supervisory authority (e.g., in Germany, the Federal Commissioner for Data Protection and Freedom of Information, BfDI).

7. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. This may include transfers to service providers outside the EU, such as AI service providers, where appropriate safeguards are applied.

We implement appropriate technical and organizational measures to protect your data from unauthorized access, disclosure, or loss. These include encryption and secure storage.

9. Children's Privacy

While our platform's content is suitable for all ages, users who wish to create an account and contribute content must have the capacity to provide valid consent for data processing under applicable laws. In the EU, this typically means being at least 16 years old, though this age may vary by member state.

If we become aware that we have collected personal data from a user who cannot provide valid consent, we will take steps to delete this information.
